A local District and Sessions court of Islamabad today has rejected the bail plea of Imran Khan’s chief of staff Dr. Shahbaz Gill. Additional Sessions Judge Zafar Iqbal announced the verdict that was reserved yesterday after hearing all parties and councils.
According to Additional Sessions Judge Zafar Iqbal’s judgement, Dr Shahbaz Gill’s statement was “sensational” and sufficient for disturbing harmony and discipline in the most respected institution of Pakistan.
“Accused is a highly qualified and responsible person and he gave above mentioned opinion/statement on national media Although, twelve offences have been added against him during the investigation of this case but the relevant offence which prima facie attracts against him is under Section 131 PP.C which is as under:
“131 Abetting mutiny, or attempting to seduce a soldier, sailor or airman from his duty. Whoever abets the committing of mutiny by an officer, soldier, sailor or airman, in the Army, Navy or Air Force of Pakistan, or attempts to seduce any such officer, soldier, sailor, or airman from his allegiance of his duty. shall be punished with imprisonment for life, or with imprisonment of either description for a term which may extend to ten years, and shall also be liable to fine.” Reads the detailed verdict.

The written order further states that, “Accused is a leader of a national level of a popular party and he has not made the statement in indoor meeting. Statement of the accused is sensational which is sufficient for disturbing harmony and discipline in the most respected institution of Pakistan i.e. Pakistan Army. Opinion expressed by the accused is not in public interest and integrity of the country. Law does not provide that an accused shall become invariably entitled to grant of bail in every case.”
Gill’s counsel Burhan Moazzam argued that the statement of Dr. Shahbaz Gill was twisted and misinterpreted. He further added that his client was ready to bring more clarity regarding his statement and tender an apology.
Senior law expert and lawyer Abuzar Salman Niazi reacted to this written order and said that, “How come word “sensational” is enough to disturb harmony & discipline in Pakistan Army? Sensational is something which arises immediate interest&curiosity,it cant have negative connotation or ability to breach discipline.”
